The decision to apply for ASBOs is a multi agency one. Those involved in the decision making process include representatives from the Police, Youth Offending Team, Social Services, Education Welfare, RSLs, Neighbourhood Housing, Probation service and any other partners which may have an interest in the case. Expertise and available resources to stop the anti social behaviour of an individual. In most cases involving young people, measures other than ASBOs are often employed. Such measures usually include Acceptable Behaviour Contracts (ABCs) which have a heavy involvement with the YOT who attempt to seek schemes to divert the young person away from trouble. In the most extreme cases of persistent and wilfull anti-social behaviour, and where often other measures have failed, an ASBO may be sought. Conditions such as ADHD would be highlighted by the relevant agencies e.g. Social Services, Education, YOT and taken into account when making a final decision. It must also be remembered that the granting of an ASBO rests with the Magistrates. Should they feel it appropriate they are at liberty to request medical reports or any such evidence to assist in their decision making. Only 3 ASBOs have been placed on Young People in this borough, all 3 of whom were persistent young offenders (criminals). These 3 have, or are currently, also serving prison sentences and to my knowledge do not suffer ADHD. |
